The agreement
These Terms are an agreement between you and DePappa Capital LLC, a Florida limited liability company (“we”, “us”), for the Mind Over Scroll app for iPhone, this website and the What’s Next board (together, “the Service”). By using the Service you accept these Terms. Our Privacy Policy explains what we collect and why.
If you don’t accept these Terms, please don’t use the Service.
Using Mind Over Scroll
We give you a personal, non-transferable license to use the app on Apple devices you own or control, as the App Store’s Usage Rules allow, and to use this website. Mind Over Scroll is for a general audience; accounts and What’s Next are for people 13 and older. Please don’t:
- copy, sell or redistribute the app or its content, except by sharing cards with the app’s Share button;
- reverse engineer the app, except where the law allows;
- scrape, flood or automate the Service, or try to get around its limits, moderation or security;
- use the Service to break the law or to harm anyone.
Your account
You can read without an account. An account keeps your progress on any iPhone you sign in on, and to make one you must be at least 13. You sign in with Apple, with Google or with a link we email you, and you’re responsible for keeping those sign-ins secure. An account is for one person.
We keep your progress as carefully as we can, but it’s a convenience, not a guarantee. We may suspend or delete an account that breaks these Terms or tries to get around the app’s limits or security.
You can sign out, or delete your account with Delete account, at any time: in Profile, tap your account. Deleting it is immediate and can’t be undone; the Privacy Policy explains what it removes. Premium belongs to your Apple Account, not to your Mind Over Scroll account, so deleting the account doesn’t cancel a subscription.
What’s Next
What’s Next, in the app, lets readers vote on what we add next and suggest ideas. Anyone can read it. Voting and suggestions are part of Premium, and also need an account, which is only for people 13 and older.
What you can post
Suggestions are plain text: links, web and email addresses, handles, phone numbers and markup are refused. Please don’t post anything that:
- is offensive or hateful, such as insults, slurs, harassment, threats, or sexual or violent content;
- is spam or advertising, or promotes a product, a site or a scheme;
- names a private person, or shares anyone’s contact details or other personal information;
- breaks the law, or infringes anyone’s copyright, trademark or other rights.
Moderation and reports
A moderator reads every suggestion before it appears, and may decline any of them. Anyone can report an idea with Report or block, and anyone signed in can block whoever suggested it. A moderator reviews every report, and may remove ideas and suspend accounts that break these rules. For anything urgent, write to hello@mindoverscroll.com; we aim to answer urgent reports within one business day.
Your ideas
You keep any rights you have in what you suggest, and give us a free, worldwide, perpetual license to publish it on the board, adapt it and build what it describes, without credit or payment. Please suggest only ideas you’re free to share. Votes and suggestions help us decide, but we choose what to build and when.
Deleting your account deletes your votes and suggestions with it. The Privacy Policy explains what happens to ideas already on the board.
Our content
Every passage in Mind Over Scroll is in the public domain in the United States, and the paintings, engravings and photographs are public domain or CC0, each credited in the app under Profile › Sources and translations. Our selection and arrangement, the Plain English versions, notes and quizzes, and the app’s design and code belong to us or our licensors.
The Plain English versions and notes are our own readings, written for learning and reflection. They aren’t legal, financial, medical or religious advice, and no reading captures everything a passage can mean.
The App Store
If you got the app from the App Store, your license to use it is also governed by Apple’s standard Licensed Application End User License Agreement (the “Standard EULA”). These Terms add to it. Where they conflict about your license to the app, the Standard EULA controls.
These terms apply too, and take precedence over anything in these Terms that conflicts with them:
- These Terms are between you and us, not Apple, and we, not Apple, are solely responsible for the app and its content. Nothing in these Terms conflicts with the App Store Terms of Service, which you’ve had the opportunity to review.
- Your license is limited to a non-transferable license to use the app on Apple-branded products you own or control, as the Usage Rules in the App Store Terms of Service allow, except that other accounts associated with you through Family Sharing or volume purchasing may also use it.
- We alone are responsible for maintaining and supporting the app. Apple has no obligation to provide any maintenance or support for it.
- We alone are responsible for any product warranties not effectively disclaimed. If the app fails to conform to a warranty that applies, you may tell Apple, and Apple will refund what you paid for the app, if anything. To the extent the law allows, Apple has no other warranty obligation for the app, and any other claims, losses, liabilities, damages, costs or expenses from a failure to conform are our responsibility.
- We, not Apple, are responsible for addressing any claims relating to the app or your possession and use of it, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If anyone claims that the app, or your possession and use of it, infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
- You confirm that you aren’t located in a country subject to a US Government embargo, or designated by the US Government as “terrorist supporting”, and that you aren’t on any US Government list of prohibited or restricted parties.
- Questions, complaints and claims about the app go to us, at the address in Contact.
- You must follow any third-party terms that apply when you use the app, such as those of your wireless data service.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple has the right, and is deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
Disclaimers
The Service is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including of merchantability, fitness for a particular purpose and non-infringement, and we don’t promise that the Service will be uninterrupted, error-free or always accurate.
Some places don’t allow these exclusions, so they may not all apply to you. Nothing in these Terms limits rights you have as a consumer that the law doesn’t let us limit.
Liability
To the extent the law allows, we aren’t liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from the Service. Our total liability for any claim about the Service is limited to the greater of what you paid for it in the 12 months before the claim, or US$50.
These limits don’t apply to liability the law doesn’t allow us to limit, such as for death or personal injury caused by negligence, or for fraud.
Ending
You can stop at any time: cancel your subscription in Settings, delete your account, and delete the app. We may suspend or end anyone’s account or access to What’s Next if they break these Terms, and we may change or stop parts of the Service. If we stop offering Premium, we’ll tell you in advance and stop renewals.
The sections on our content, the App Store, disclaimers, liability and governing law continue after these Terms end.
Governing law
These Terms are governed by the laws of the State of Florida and of the United States, without regard to conflict-of-law rules. Any dispute goes exclusively to the state courts in Hillsborough County, Florida, or the U.S. District Court for the Middle District of Florida. If you’re a consumer in the European Union or the United Kingdom, you also keep the protection of the laws where you live, and can bring a claim in your local courts.
Changes
We may update these Terms. We’ll post the new version here with its date and, if a change matters, tell you in the app or on this site before it takes effect. If you keep using the Service after that, the updated Terms apply.
